Overriding Effect of the RTI Act
The Right to Information (RTI) Act, 2005, has an overriding effect as specified in Section 22 of the Act. This section states:
"The provisions of this Act shall have effect notwithstanding anything inconsistent therewith contained in the Official Secrets Act, 1923, and any other law for the time being in force or in any instrument having effect by virtue of any law other than this Act."
This means that if there is any conflict between the RTI Act and other laws, the provisions of the RTI Act will prevail. This ensures that the right to information is upheld and cannot be overridden by other laws that might restrict access to information.
