When can penalty be imposed?

RTI Penalty Provisions

  1. Refusal to Receive Application: If the PIO refuses to accept an RTI application without reasonable cause.
  2. Failure to Provide Information: If the PIO fails to provide the requested information within the stipulated 30 days.
  3. Malafide Denial: If the PIO denies the request for information with malafide intent.
  4. Providing Incorrect Information: If the PIO knowingly provides incorrect, incomplete, or misleading information.
  5. Destruction of Information: If the PIO destroys the information that was requested.
  6. Obstruction: If the PIO obstructs the furnishing of information in any manner.

The penalty imposed is ₹250 per day of delay, subject to a maximum of ₹25,000. The burden of proof lies on the PIO to show that they acted reasonably and diligently. Additionally, the Information Commission can recommend disciplinary action against the PIO under the applicable service rules.
